Sure. But this strikes me as EXACTLY the same thing as randomly firing a gun into a crowd. If someone doesn't get hurt/killed, it's an act of luck. Anyone legally mentally competent should realize that. Therefore, he's either insane, or should be treated as a murderer.
Second-degree is probably more accurate: reckless indifference to human life. aka, you did something you knew could get someone killed, and you just didn't care. I'm not sure what the difference in penalties is.
There's no such thing as too much L&O. My sister and I have watched so much we can spot some episodes in 5 seconds or less. Which should probably not make me as happy as it does. *grin* (Still not as geeky as recognizing Hitchhiker's Guide from the countdown clock at the beginning, but almost as much fun.)
Agreed. However, I want to know what kind of laptop this guy was using, since the article says it was thrown from his car, and yet was still running when they found it.
And I was having such a nice day until I saw this. I wonder if we can get in touch with the law system around there and beg for him to be tried as a murderer. This "reckless endangerment" or "homicide by negligence" bullshit (as you so eloquently put it) is just that -- bullshit.

Playing with a goddamn laptop while driving. Un-fucking-believable. This is why irons have to have labels that say "do not iron clothes while wearing them". Darwin's law, but dammit he killed and injured other people.
Fucking minimum he should have his driver's license and detective license (if he even needs one..) revoked permanently, and he should be charged with murder. And then have him sit in a small car while someone rams him with a fucking minivan while playing with a laptop.
